"These Terms of Service govern your access to and use of the CoworkingView website and intermediary services. By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please refrain from using our services."

Article 01

Scope of Application

These Terms apply to all users of the CoworkingView website (coworkingview.com) and to any person who contacts us to make use of our intermediary services — whether as a company seeking a coworking space or as a coworking space operator. Use of the website constitutes acceptance of these Terms. CoworkingView reserves the right to amend these Terms at any time; the version published on the website at the time of use applies.

Article 02

Service Description and Legal Status

CoworkingView is currently in an informational phase:

Information Directory: CoworkingView operates purely as an information and business directory for coworking spaces. The platform serves exclusively to present information about available office spaces and workstations.
No Brokerage Activity: CoworkingView currently expressly does not act as a real estate broker within the meaning of § 652 BGB or § 34c GewO. There is no active brokerage of rental or lease agreements. CoworkingView does not provide individual advice or influence the conclusion of a contract between the user and the provider of the coworking space.
Conclusion of Contracts: Contracts regarding the use of coworking spaces are concluded exclusively and directly between the user and the respective provider (space operator). CoworkingView is not a contracting party, representative, or vicarious agent of the parties involved.
Disclaimer for Information: All data regarding the listed spaces (prices, availability, amenities) is provided by the respective operators. CoworkingView does not warrant the accuracy, completeness, or timeliness of this third-party content.
Article 03

User Obligations

When using our website and services, you agree to:

Provide accurate, complete, and up-to-date information in all communications and forms.
Use the website for lawful purposes only and in accordance with applicable law.
Refrain from attempting to disrupt, overload, or interfere with the website or its infrastructure.
Not transmit spam, malware, or any content that is unlawful, defamatory, or infringing.
Notify us promptly if you no longer require our services or if you have directly concluded an agreement without our involvement after receiving a referral from us.

Competitive misuse: using our services to build a competing operator database or gather competitive intelligence for a rival intermediary.
Fraud: submitting false, fabricated, or misleading enquiries, contact details, or company information; impersonating any person or entity.
Illegal activity: money laundering, tax fraud, bribery, corruption, or use in breach of applicable sanctions.
Spam: sending unsolicited commercial messages using contact details published on this website, in violation of TDDDG or UWG.
System interference: attempting unauthorised access to systems; introducing malware or conducting denial-of-service attacks.
IP infringement: reproducing or creating derivative works from website content without prior written consent.

Users should verify all material information directly with the relevant operator before making any decisions.

Website Availability

CoworkingView is not liable for losses from unavailability unless caused by its own intentional misconduct or gross negligence. Limitation of Liability

To the fullest extent permitted by German law: CoworkingView's liability is limited to cases of intentional misconduct (Vorsatz) and gross negligence (grobe Fahrlässigkeit). In cases of simple negligence, CoworkingView shall only be liable for breach of a material contractual obligation (Kardinalpflicht), and such liability shall be limited to foreseeable, typical damages. CoworkingView assumes no liability for: the content, availability, or suitability of any coworking space; decisions made by users on the basis of information published on the website; technical failures or unavailability of the website; or the conduct of third-party operators. The preceding limitations do not apply to liability for injury to life, body, or health, or to mandatory statutory liability.

Article 10

Indemnification

You agree to indemnify, defend, and hold harmless CoworkingView, its proprietor Carlos Müller González, and any employees, collaborators, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of our website or services; (b) your breach of these Terms; (c) your violation of any applicable law; (d) your infringement of any third-party right; or (e) any misrepresentation by you. This obligation survives termination of your use of the services.

Article 11

Force Majeure (Höhere Gewalt)

CoworkingView shall not be liable for any delay or failure in performance where such failure results from circumstances beyond its reasonable control (höhere Gewalt), including: acts of God; natural disasters; pandemic or public health emergency; war, terrorism, or civil disturbance; government action; cyberattacks or infrastructure failures not attributable to CoworkingView’s negligence; or industrial action. CoworkingView will notify affected parties promptly and resume performance as soon as reasonably practicable.

Our website uses cookies and similar technologies. The processing of personal data in connection with your use of the website is governed by our Privacy Policy, which forms an integral part of these Terms. By using the website, you acknowledge our Privacy Policy.

Article 13

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions and excluding the UN Convention on Contracts for the International Sale of Goods (CISG). To the extent permitted by law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Berlin, Germany.

Online Dispute Resolution (§ 36 VSBG)

CoworkingView is not obliged to participate in consumer arbitration proceedings and generally does not do so. B2B disputes are resolved exclusively before the courts of Berlin.

Article 15

Entire Agreement

These Terms, together with the Privacy Policy and any other policies published on the website, constitute the entire agreement between you and CoworkingView regarding the use of our website and services. They supersede all prior oral or written agreements, representations, and understandings on the same subject matter.

Article 16

No Waiver

No failure or delay by CoworkingView in exercising any right under these Terms operates as a waiver. No single or partial exercise of any right precludes any other or further exercise. Rights and remedies under these Terms are cumulative and not exclusive of rights provided by applicable law.

Article 17

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by one that most closely approximates the commercial intent of the original provision.

Article 18

Assignment

You may not assign, transfer, or sub-licence your rights or obligations under these Terms without CoworkingView’s prior written consent. CoworkingView may freely assign its rights and obligations, including in connection with a business transfer, merger, or restructuring. Any purported assignment in violation of this clause is null and void.

Article 19

Language

These Terms are provided in English, German, and Spanish for the convenience of international users. In the event of any conflict between versions, the German-language version shall prevail, as German law governs and CoworkingView operates primarily in Germany.

Article 20

Changes to these Terms

CoworkingView reserves the right to modify these Terms at any time. Changes will take effect upon publication on the website. Continued use of the website after publication constitutes acceptance of the revised Terms. We recommend that you review these Terms regularly.
